Buying a Ready Home in Dubai 2026: Form F to Title Deed

A Dubai ready-home purchase runs in order: sign Form F and pay a deposit, usually 10%; the seller clears dues and gets the developer’s NOC; the transfer is registered at a trustee office; a new title deed follows. The 4% DLD fee is mostly the buyer’s. Ready-home sales rose 16% in Q3 2026.

What are the steps to buy a ready home in Dubai, in order?

The Dubai Land Department (DLD) registers the transfer, through a trustee office. betterhomes counted 10,055 ready-home sales in Q3 2026 (Khaleej Times, 15 October 2026). The table shows who acts at each step, which paper and money move, and the time the sources report.

What is Form F, and what should I read before paying a deposit?

Form F is the sale contract for a ready home, and sources also call it the MOU. Real Estate Club Dubai (REC) says an MOU made through a RERA-registered broker is known as Form F. Binghatti calls it mandatory for all secondary-market sales and Property Finder says all parties must sign it to make it valid, but neither cites a rule. We did not find the rule itself, so ask the trustee office or a lawyer whether your deal needs anything more.

It records the price, deposit, payment schedule, transfer date and who bears each fee. Binghatti says the deposit is usually 10% and Property Finder says at least 10%, but who holds it is not agreed: the seller (Property Finder), the agent or trustee until transfer (betterhomes), or the seller or an escrow account (REC).

How binding it is differs too. LY Lawyers and betterhomes treat it as binding; LY advises legal scrutiny before signing. One Property Finder page says an MoU is not legally binding while also describing a 30-day window after which Form F becomes void; Binghatti says “often around 30 to 60 days”. The date in your own Form F decides, so treat it as a contract that commits you.

What does the seller have to clear before the transfer?

The seller must settle outstanding service charges with the developer, obtain a clearance certificate and clear DEWA, Empower and du bills. Then the developer checks the unit’s outstanding charges and issues the NOC, confirming the unit can be sold. Compare the unit’s service charge with what owners actually pay.

The NOC costs AED 500 to AED 5,000 plus VAT, and REC says the seller pays it in nearly all standard MOUs. Timing varies: 3 to 7 business days on one REC page and 5 to 21 days by developer on another. REC says an NOC is usually valid for 30 days; if the transfer misses that window, the seller applies again and pays again.

If the unit has a mortgage, the seller must settle it and lodge a manager’s cheque for the balance with the bank. betterhomes puts the liability letter and then the clearance letter at “seven to fourteen working days”; REC says 5 to 10 business days and advises planning for at least two weeks.

What changes if I use a mortgage?

In its mortgage regulations the Central Bank sets a maximum 80% loan for an expatriate buying a first home under AED 5 million and 60% for a second or investment home. The same text says a bank must obtain an independent on-site valuation before any irrevocable commitment to lend, and the Central Bank expects the down payment to come from the borrower’s own resources, not from personal loans or credit cards. Banks may lend less than the cap, and we did not find what cap a non-resident buyer gets, so ask the bank.

REC puts the valuation at 3 to 5 business days and says your mortgage is registered against the new deed alongside the transfer; the registration fee is paid at the same trustee appointment. The cap table and that fee are in our purchase-cost guide.

What happens at the trustee office, and when do I get the title deed?

Both parties attend, or an attorney under a power of attorney; you book through the Dubai REST app or by phone. The trustee office vets the documents and payment, then submits the transaction to DLD for approval. The final payment is usually a manager’s cheque, and REC says cash is not accepted for the DLD fee.

Under Dubai Law No. 7 of 2006 on Real Property Registration, a transaction that transfers a property right “will not be deemed valid unless recorded” in the Property Register (Article 9), and the Land Department issues title deeds from that register (Article 22); the portal’s English text is a translation and the Arabic original governs. LY Lawyers puts registration to new deed at about one business day once documents are in order, and REC says mostly the same day, digitally in Dubai REST.

Who pays the 4% DLD fee and the other costs?

The sources do not agree, so write each line into Form F.

  • The 4% DLD fee: Property Finder (3 July 2026) says it is legally split 2% each but commonly paid in full by the buyer; REC calls that a market norm, not a legal requirement; and DLD’s notice of 31 May 2021, written for developers, says the 4% is paid “based on the agreement concluded between the seller and the buyer”. On AED 2,000,000 the fee is AED 80,000, and the gap between “buyer pays all” and “split 50/50” is AED 40,000 (our arithmetic).
  • Broker commission (2% plus 5% VAT): Property Finder and LY Lawyers put it on the buyer, betterhomes on the seller, and REC on “seller (standard) or split”.
  • Trustee office: LY Lawyers says “typically AED 2,000 to 5,000”; Property Finder gives AED 2,000 under AED 500,000 and AED 4,000 above, plus 5% VAT.

In our arithmetic a cash purchase of an AED 2,000,000 apartment carries about 6.3%, AED 126,780, beyond the price, before any NOC; Property Finder budgets 7% to 10% including a mortgage and other charges. Put your own price into the cost-of-buying calculator.

How long does buying a ready home take?

REC (5 April 2026) says 1 to 2 weeks from signing the MOU to the new deed when documents are ready and there is no loan, and 3 to 5 weeks with one. betterhomes (15 March 2026) says most sales take 4 to 8 weeks (30 to 60 days in its FAQ), and does not say where its count starts, so do not set the two side by side.

Can I buy from abroad, or online?

REC says a power of attorney is needed if either party cannot attend. betterhomes says it must be notarised and accepted by DLD, and REC adds that one signed abroad must be attested at a UAE embassy or consulate and that a vague one is rejected. Ask the trustee office to approve the wording before it is signed.

On 13 October 2025 DLD launched the first phase of “Digital Sale” in the Dubai Now app, with UAE Pass signatures. But both parties must hold a valid Emirates ID and an active UAE Pass account, and the property must be freehold, with no mortgage and a single owner; a buyer without an Emirates ID is outside it as described. We found no report of a later phase, so ask Dubai Now for the current conditions.

What would we check before you sign Form F?

This is Jalili Real Estate’s advisory read, built only from the sources above and not from a client file. First, the clocks. They run side by side and each runs out separately: the Form F completion window (30 days in one source, 30 to 60 in another), the NOC’s validity (usually 30 days), the seller’s bank letter (up to 14 working days) and your own valuation (3 to 5 business days). Fourteen working days is about three calendar weeks and a 21-day NOC uses most of a 30-day window (our arithmetic), and an expired NOC means a second NOC and a second fee, so ask the seller for dates, not “soon”.

Second, the deposit. 10% of AED 2,000,000 is AED 200,000 (our arithmetic), and it leaves you before you know the NOC will issue, the seller’s loan will be cleared and your own loan approved. Property Finder says an MoU can carry conditions such as financing approval or property inspections; ask whether your Form F has one. Whether the deposit comes back in each case, the sources cannot say; a lawyer reads that from the contract.

Check the broker’s licence by ORN and BRN before you sign; off-plan runs in a different order, set out in buying off-plan in Dubai, end to end. Confirm each step and fee with the trustee office and a UAE-qualified lawyer before you sign. We do not cover tax; seek tax advice.

This is general information, not financial or legal advice; check every figure with your adviser before you act.

What is Form F in a Dubai resale?

Form F is the sale contract for a ready home; sources also call it the MOU. Binghatti (24 July 2026) says it records the price, deposit, payment schedule and transfer date, with a deposit usually of 10%. Sources disagree on who holds the deposit and how binding the form is, so have a lawyer read it before you sign.

Who pays the 4% DLD fee when buying a ready home?

Property Finder (3 July 2026) says the 4% is legally split 2% each but commonly paid in full by the buyer. DLD's 31 May 2021 notice, written for developers, says it is paid per the agreement between seller and buyer. On AED 2,000,000 the fee is AED 80,000, so write the split into Form F.

How long does a Dubai property transfer take?

Real Estate Club Dubai (5 April 2026) says 1 to 2 weeks from signing the MOU when documents are ready and there is no loan, and 3 to 5 weeks with one. LY Lawyers (5 February 2026) says registration at the trustee office takes about one business day once documents are in order.
